Eligibility
Services are available to individuals and businesses that can form legally binding contracts under applicable laws. Users must provide accurate identification and contact information as part of registration and contractual processes.
Users must be at least 18 years old or have legal capacity under local law to enter into and perform contractual obligations for the services provided by DevMCore.
Services must be used for lawful purposes only. Users must not use DevMCore services to engage in activities that violate applicable laws in Malaysia or in jurisdictions where the services are accessed.
Access to some services may be restricted in certain jurisdictions. Availability of specific software development features can vary by country and local regulation; users are responsible for complying with local requirements.
Account and Registration
To access certain DevMCore services you may need to create an account. Account creation requires providing accurate information and maintaining the confidentiality of account credentials.
You agree to keep account information complete and up to date. DevMCore is not responsible for problems caused by inaccurate or outdated contact or billing information.
Protect account credentials and restrict access to authorized personnel. Notify DevMCore promptly if you suspect unauthorized access. DevMCore implements reasonable technical and administrative safeguards to protect account data.
Accounts are personal and non-transferable unless otherwise agreed in a written contract between DevMCore and a business client.
If you believe your account has been compromised, contact DevMCore support immediately at +60124353777 and follow any security instructions provided. Quick notification helps mitigate potential misuse.
DevMCore may suspend accounts that violate these terms, pose security risks, or result in suspicious activity. Suspensions are intended to protect users and the service; restored access will follow resolution.
Services Provided
DevMCore provides custom business software development, integration, maintenance and consulting services. Project scope, deliverables, timelines and specifications are defined in individual statements of work or contracts.
DevMCore may update services, features or platform components to maintain security, compliance and performance. Substantive changes affecting contracted deliverables will be communicated and managed through the contract process.
DevMCore strives for reliable service delivery. Maintenance windows and scheduled downtimes will be communicated in advance where feasible. Availability depends on factors including infrastructure, third-party dependencies and client cooperation.
Acceptable Use
Users must follow rules that protect service integrity and other users. Prohibited activities are listed below and apply to any use of DevMCore systems or services.
- Using the service to engage in illegal activities, fraud, or unauthorized access to systems.
- Uploading or distributing malware, viruses, or other harmful code through DevMCore services.
- Attempting to interfere with, degrade or circumvent service operations or security measures.
- Misrepresenting identity, business affiliations, or contractual relationships with DevMCore.
- Using the service to distribute unsolicited commercial messages or spam.
- Reverse engineering or attempting to extract source code from DevMCore proprietary products unless expressly permitted.
- Violating intellectual property rights or the privacy of others through content uploaded or transmitted via DevMCore systems.
User Content
User content consists of code, data, documents and other materials users upload, submit or transmit while using DevMCore services. Users retain ownership of their user content subject to the rights they grant to DevMCore.
Users keep ownership of their pre-existing intellectual property and content provided for custom development work, except for components that DevMCore licenses from third parties under separate terms.
By submitting content to DevMCore you grant us a limited, non-exclusive license to host, copy, modify and use the content as necessary to provide services, perform maintenance and comply with contractual obligations related to your project.
Users are responsible for the legality, accuracy and security of content they provide. DevMCore is not responsible for harmful or unlawful content submitted by users and may remove material that violates these terms.
DevMCore may remove or restrict access to user content that violates these terms, applicable laws, or third-party rights. Removal actions will be taken in accordance with internal policies and legal obligations.
Intellectual Property
Intellectual property rights in software, documentation and deliverables depend on contractual terms. Standard projects usually result in client ownership of custom-created deliverables after full payment, with DevMCore retaining rights to pre-existing tools, libraries and methodologies.
- Do not reproduce or distribute DevMCore proprietary code or internal tools without written consent.
- Clients receiving custom deliverables should not remove or alter notices of ownership or licensing included in the deliverables.
- Use of third-party licensed components within a project is subject to the original third-party license and may impose additional obligations.
Paid Services
Paid services include custom development projects, support subscriptions, hosting, and other fee-based offerings. Specific terms are set out in individual proposals and invoices.
Pricing is based on scope, resource estimates and agreed deliverables. Quotes are valid for the period stated in the proposal. Additional work outside the scope is billed separately.
Payment terms, accepted payment methods and invoicing schedules are specified in contracts or proposals. Late payments may lead to suspension of services until accounts are current.
Subscription services are billed according to the subscription period outlined in the agreement. Renewal terms are described in the subscription contract and require timely payment to continue access.
Refunds are handled according to the specific service agreement. For custom development work, refunds are evaluated against work completed and costs incurred; credit may be offered where appropriate and consistent with the contract.
Project cancellations should be notified in writing. Termination fees or final invoices may apply to cover work performed up to the cancellation date and any non-recoverable costs.
Clients are responsible for applicable taxes, duties or levies related to fees paid to DevMCore unless otherwise agreed. DevMCore will comply with tax reporting obligations as required by law in Malaysia.
DevMCore may update pricing for future work. Changes affecting active contracts will follow the amendment procedures defined in those contracts.
Non-payment may result in suspension of services, withholding of deliverables, or referral to collections. DevMCore will make reasonable efforts to resolve disputes before escalating.
Disclaimer
Information and services provided by DevMCore are offered as-is for informational and operational use. DevMCore does not provide legal, tax, or regulatory advice as part of standard software development engagements; clients should consult appropriate advisors for those matters.
Limitation of Liability
To the maximum extent permitted by law, DevMCore's liability for direct damages arising from services is limited to amounts paid by the client for the specific service. DevMCore is not liable for indirect, incidental or consequential losses such as lost benefits or data loss except where required by applicable law.
Third-Party Services
DevMCore may integrate third-party services, APIs or libraries into projects. Use and availability of third-party components are subject to those providers' terms and may affect functionality or require separate agreements.
Termination
Either party may terminate a contract in accordance with the termination clauses stated in the applicable agreement. Termination does not relieve the client of payment obligations for services performed prior to termination.
Upon termination, DevMCore will deliver completed work according to the contract and may provide transition assistance where agreed. Intellectual property and license terms described in the project agreement will survive termination as specified.
Privacy and Data Protection
DevMCore collects and processes personal data necessary to deliver services, communicate with clients and fulfill contractual obligations. Data handling practices are described in DevMCore's privacy policy available at DevMCore.pro/privacy. Clients are responsible for ensuring lawful instructions for personal data they provide.
Communications
DevMCore communicates via email, phone and agreed collaboration tools. By using services, users consent to receive communications related to their projects. Official notices regarding contractual matters will be sent to the contact information provided by the user.
Changes to Terms
DevMCore may update these Terms from time to time. Material changes will be communicated to active clients and will apply to new work or as otherwise agreed. Continued use of services after notification constitutes acceptance of the updated terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia. Parties submit to the non-exclusive jurisdiction of Malaysian courts for disputes that cannot be resolved through negotiation or alternative dispute resolution.
Dispute Resolution
Parties should attempt to resolve disputes through good-faith discussions. If unresolved, disputes may be referred to mediation or arbitration as agreed in the applicable contract. Where mediation or arbitration is not used, Malaysian courts will have jurisdiction.
